Terms and Conditions of Sale

1. Who we are and scope

1.1 These Terms and Conditions govern the sale of products through the website www.tagliovivo.it (the “Site”). The seller is GFM S.R.L., operating under the brand Tagliovivo:

1.2 Each purchase is a distance contract governed by Articles 45 et seq. of Italian Legislative Decree 206/2005 (the “Consumer Code”). The “Customer” is the person or entity who places an order on the Site. Customers who are natural persons must be at least 18 years old.

1.3 These Terms may be updated at any time. The version published on the Site at the time of the order applies to that order.

2. Orders

2.1 To place an order, the Customer adds products to the cart and clicks “Proceed with payment”. The contract is concluded when payment is successfully completed. GFM S.R.L. will send an Order Confirmation to the e-mail address provided by the Customer within 48 hours.

2.2 If any essential element of the order changes before shipment (for example product characteristics, price, delivery costs or delivery method), we will inform the Customer. If the Customer does not accept the change, the order will be cancelled and any amount already paid will be refunded in full.

2.3 If a product is unavailable, we will ship it as soon as it becomes available, and in any case within 30 days. If we cannot supply it within that period, we will inform the Customer and refund any amount paid.

3. Prices and payment

3.1 All prices are in euros and include VAT. Special offers and discounts are valid only for the stated period and must be active at the time the order is confirmed.

3.2 Accepted payment methods:

• PayPal
• Credit card (via Stripe)
• Cash on delivery (Italy only; any cash-on-delivery fee is charged to the Customer)

3.3 We take every reasonable care to publish correct prices. If we find an error in the price of a product you have ordered, we will contact you and you may choose to confirm the order at the correct price or cancel it with a full refund.

4. Shipping and delivery

4.1 Orders are shipped by tracked express courier to the address provided by the Customer, within approximately 5 working days of payment confirmation.

4.3 Duties and taxes for non-EU destinations. For shipments outside the European Union, the Customer is responsible for all import duties, customs fees and local taxes charged by the destination country. The courier will contact the Customer to request payment when the parcel reaches customs, and delivery may be delayed until these charges are paid. GFM S.R.L. has no control over these charges. We recommend checking with your local customs office before ordering: unforeseen duties or import charges are not a valid reason to cancel an order.

5. Right of withdrawal (returns)

5.1 Withdrawal period. The Customer may withdraw from the contract without giving any reason within 14 calendar days from the day the Customer, or a third party designated by the Customer, receives the products.

5.2 How to withdraw. The Customer must send a clear statement of the decision to withdraw:

• by e-mail to info@tagliovivo.it, or
• by post to GFM S.R.L., Via Arturo Toscanini 11, 70021 Acquaviva delle Fonti (BA), Italy.

The Return / Withdrawal Request Form on the Site may be used but is not mandatory. The deadline is met if the communication is sent before the 14-day period expires. We will acknowledge receipt promptly and provide a Return Authorization (RA) number and the return address.

5.3 Returning the products. The Customer must send the products back within 14 days of communicating the withdrawal. The deadline is met if the products are handed to the carrier before the 14 days expire.

5.4 Condition of returned products. Products must be returned complete with original packaging, tags and accessories. The Customer is liable only for any loss in value caused by handling beyond what is necessary to examine the nature, characteristics and functioning of the product (as one would in a shop).

5.5 Return costs are paid by the Customer. All direct costs of returning the products are borne entirely by the Customer. This includes:

• the courier or postal shipping cost;
• for returns from outside the European Union, any customs duties, taxes and clearance fees.

On request, GFM S.R.L. can arrange collection through its own courier; in this case, the collection cost will be deducted from the refund. The risk of loss or damage during the return shipment lies with the Customer, so we strongly recommend a tracked and insured service. Parcels sent to us with charges to be paid on arrival will not be accepted.

5.6 Refund. We will refund the price of the returned products and the original standard delivery cost within 14 days of receiving the withdrawal communication. If the Customer chose a delivery method more expensive than our cheapest standard option, the difference will not be refunded. The refund is made using the same payment method as the original purchase, unless the Customer expressly agrees otherwise; orders paid cash on delivery are refunded by bank transfer to the IBAN provided by the Customer. We may withhold the refund until we have received the products back or the Customer has provided proof of shipment, whichever comes first.

5.7 Exclusions. The right of withdrawal does not apply to products made to the Customer’s specifications or clearly personalised (e.g. made-to-measure items or items with initials or custom engravings).

5.8 Exotic leather products (CITES). Products made of exotic leathers regulated by CITES (Convention on International Trade in Endangered Species) can be returned from outside the European Union only with the required CITES export and import permits. Customers outside the EU must contact us before shipping these products so that we can provide instructions. Products returned without the required documents may be held or seized by customs, and GFM S.R.L. cannot be held responsible for this.

6. Legal guarantee of conformity

6.1 All products are covered by the legal guarantee of conformity under Articles 128 et seq. of the Consumer Code for any defect that becomes apparent within 24 months of delivery.

6.2 To report a defect, the Customer should write to info@tagliovivo.it, describing the problem and attaching photos of the product and the defect.

6.3 If a defect is confirmed, the Customer is entitled to free repair or replacement, including return shipping costs, which in this case are paid by GFM S.R.L. Where the conditions established by law are met, the Customer may instead obtain a price reduction or terminate the contract.

6.4 The guarantee does not cover normal wear and tear, improper use, or damage caused by failure to follow the care instructions.

7. User account

Registration on the Site is free and open to adults and legal entities with a valid e-mail address. The Customer must provide accurate information and may hold only one account.

8. Personal data

Personal data is processed by GFM S.R.L. as data controller in accordance with EU Regulation 2016/679 (GDPR) and Italian Legislative Decree 196/2003, as amended. Data is used mainly to manage orders, deliveries, payments, customer service and legal obligations. Marketing communications are sent only with the Customer’s consent, which can be withdrawn at any time. Full details are available in the Privacy Policy on the Site. 9. Governing law and jurisdiction

These Terms are governed by Italian law. For Customers residing in Italy, the competent court is that of the Customer’s place of residence or domicile. For Customers residing abroad, the competent court is the Court of Bari, without prejudice to any mandatory rights granted to consumers by the law of their country of residence.
